Terms and Conditions of Unveels Online Platform

Use of UNVEELS online platform in any way constitutes acceptance of these terms and conditions, and UNVEELS has the right to amend them at any time without prior notice, as they will be effective from the date of publication, or the date specified for publication. Also, the use of the online platform after publishing any change constitutes agreement to the terms of use that it has been modified.

A- These terms and conditions were established to preserve the rights of service providers, relevant companies, customers, and UNVEELS. These terms and conditions govern your use of this platform as follows:

Platform: The UNVEELS online platform includes the website and applications for modern devices.

Clients: Users of the UNVEELS online platform.

Competent company: It is the company, entity, or person that produces or manufactures goods and products, or the sales agent, distributor, or any third party who displays or sells goods and products in the market to the public, including, but not limited to, sales outlets, stores, exhibitions, and holders of the goods. And products for the purpose of selling to the public, and the platform is used to display and deliver those goods and products that are purchased from the market from those parties or others from the market in their condition through sales outlets or stores, and the platform is a mediation platform and not a registered agent or distributor for those goods or products and cannot be considered as such. 

B- To use the online platform, the customer must be of the legal age eligible to transact in his country of residence.

C- In order for the customer to order any product through the online platform, he must adhere to the necessary steps through the online platform and provide the required personal information.

D- The customer must provide correct, complete, and current data regarding the required information, and he must update his data continuously and immediately. He is also responsible for ensuring the confidentiality of the information and data related to his account and that all persons who access the platform through his account are aware of this platform’s terms and their commitment to them.

E- The customer bears responsibility for the product evaluation he writes on the online platform (if available). He is also fully responsible for his comments and contributions and undertakes that they will not contain defamatory or illegal, offensive, or obscene material, or contain any computer virus and that his comments will not Violate any right of any third party, including copyright, trademark, privacy, personality or other proprietary or personal rights. He may also not use a false e-mail address, claim to be someone other than himself, or otherwise mislead us or any third parties. UNVEELS also has the right to delete any comment or block part of it without giving reasons.

F- The customer's acceptance of the terms and conditions of using the platform constitutes his authorization to UNVEELS to purchase the products offered through the platform and deliver them to the address he specifies when placing the order.

These terms and conditions apply to the UNVEELS website, its page on social media, and all its applications on iPhone, iPad, Android devices, and phones connected to the Internet browser.

 

Description of Services

1. The platform was created to be a comprehensive online complex for cosmetic products and tools, and UNVEELS is a commercial platform for displaying and delivering these products through the Internet to the address specified by the customer in exchange for a fee.

2. The platform does not interfere in any way in the production, manufacture or preparation of any product, and what it offers to customers is only the ability to search and find the products offered and deliver them through the platform, and the competent company is solely responsible for compliance with the laws, regulations, systems, and standards. And the standards applied in the country, such as those related to the production, preparation, sale, marketing, and safety of the product.

3. Customers are solely responsible for ensuring that delivery addresses are correct and UNVEELS will not have any liability or responsibility for any incorrect addresses.

  Products

1. All services offered on the platform are immediately implementable (online).

2. Some products on the UNVEELS website/application are not available for same-day delivery unless otherwise specified.

3. The UNVEELS platform is merely an online intermediary between the customer and the competent company and does not bear any responsibility in the event of a delay in implementation or a change in the conditions or goods and their specifications that were agreed upon between the customer and the competent company. Likewise, UNVEELS is not responsible for any violations or legal violations that may be committed by the competent company. For example, but not limited to, the use of illegal or counterfeit goods, the use of third-party trademarks, failure to adhere to approved and applicable quality and safety standards, and obtaining the necessary permits and approvals to manufacture the product in accordance with local laws in the State of Kuwait and any other country in which the products are displayed or differ from Displayed and other irregularities and violations.

4. UNVEELS does not confirm in any way the components or quality of any products or that the competent company adheres to the laws and regulations in force for the manufacture of their products, as this responsibility lies with the competent company alone. Customers should review the information available on the platform.

5. UNVEELS will not be obligated or responsible for any products provided by the relevant company that are unhealthy, cause injury, or are unacceptable to users, or that do not meet customer expectations in any way.

6. Upon completion of the process through UNVEELS, communication will be made to follow up the process and confirm the request once and for all.

7. In the event that it is not possible to confirm the sale or fulfill all or part of your request, we will contact you directly and provide alternatives that suit your needs if desired.

 

The Prices

1. The prices displayed for the product or service on the platform are specific to the relevant company and are specified in the Kuwaiti dinar or its equivalent in other currencies and according to the selling price specified in each country.

2. Product prices do not include local or foreign delivery fees or taxes, if any, in some countries. They are added to the detailed final receipt when executing the order process through the platform.

3. Local or external delivery costs depend on the area to be delivered, as these expenses are determined at the end of the implementation process.

4. UNVEELS reserves the right, without prior notice, to change the price or prices of any or all services and products offered on the platform.

5. Some specialized companies offer a special discount through a coupon, discount code, or any other method determined by the competent company or UNVEELS for platform customers. The price mentioned is the price offered before the discount, and the discount is offered after the final confirmation of the order unless otherwise specified.

6. If there is a discount on the product by the relevant company, the price will be clarified before and after the discount.

7. UNVEELS has the right to offer offers and gifts to customers according to the conditions it deems appropriate when they use the platform.

 

Execution of Operations

1. The sale and purchase of goods and products are carried out immediately (online) so that the price is paid in cash or via the debit or credit cards.

2. The goods and products purchased by the customer will be delivered to the address specified by him within a reasonable period so that when the item is sold to him, the customer inspects and inspects it.

3. In the event that it is not possible to make an appointment due to the completion of the number of appointments on the required day, another day will be scheduled at a time that suits the client.

4. The sale process is considered completed as soon as the customer receives the product that Tayeb was authorized to purchase and delivers it to his account.

5. The goods and products are delivered to the addresses specified by the customers, and delivery is for a fee that is included in the final price of the product

6. In the event that the sold product does not conform to the announced specifications, it will be returned to the delivery worker, provided that the price - if paid - will be deposited in the customer’s account and will serve as a balance that he can use in other purchases through the platform and in accordance with the policies and procedures followed in UNVEELS.

7. UNVEELS Company is keen to provide the best service to the customer to facilitate the process of communication and contracting with the competent company, but it does not guarantee any of the prices, implementation procedures, or dealing with the competent company.

8. If the customer refuses to receive the product and does not have any reasons supporting this refusal, the customer is obligated to pay the cost of delivery fees in both directions (round trip).

9. We also apologize for not accepting the return of any product whose packaging has been opened, even if it has not been used.

 

Order/Payment

1. When your order is accepted, and if you choose to pay by credit card or prepayment through the platform, then the transaction will be executed through UNVEELS as an intermediary between you and the relevant company, and the required financial amount in the value of your purchases will be withdrawn from your account immediately after completing the purchase process. If the source does not permit your card to complete the financial transaction for any reason, we will not be able to prepare your order and prepare it for delivery, and UNVEELS will not be responsible for any delays resulting from this.

2. During the ordering process, you must provide Tayyab with complete personal data, including name, phone, and delivery address, which means the recipient’s address, along with writing any other data or notes, if any.

3. The order is considered confirmed once the purchase process is completed through the platform unless the customer is notified otherwise within a period of (7) working days via a message via his email or phone number. Before determining your order, please review the terms and conditions.

4. By clicking on the “Confirm or Execute” button at the end of the order process, the customer acknowledges his agreement to be bound by the terms and conditions stipulated here and which appear elsewhere on the platform.

5. On our website, we use the “Secure Access Layer (SSL)” encryption technology to ensure the protection of payment card and credit card details and your personal information during the payment process. This technology is considered one of the best standard methods adopted in this field. However, we disclaim any moral or material responsibility for any unauthorized third party's breach of such information.

6. UNVEELS will not obtain any customer’s bank data and will not be responsible for it. UNVEELS does not save your bank card data.

 

Delivery

1. Product prices do not include local or foreign delivery fees, and they are stated separately on the platform and added to the final receipt when executing the order process through the platform.

2. Some selected products may not be available for delivery to certain areas. To the extent possible, we will inform you of these restrictions before placing your order or shortly after ordering.

3. The intended delivery date of your order will be confirmed in an order confirmation email or direct telephone call.

4. To avoid any obstructions or delays in delivery, please ensure that you have provided complete and accurate data for the intended recipient’s address and telephone number along with your contact telephone number so that we can notify you if you encounter delivery problems.

5. In the event that you encounter any difficulties in delivering your order to the intended recipient, we reserve the right to contact the recipient using the contact details you provide at the time of placing your order.

6. If the customer is not present at the address specified in the system, the products requested by the customer will not be delivered to any other place. In this case, the customer must accept all legal responsibilities arising from ordering products to an address where he does not reside.

 

Return the Product

Regarding returning the product, the product return conditions of the relevant companies apply. UNVEELS does not bear any responsibility for disputes that may arise from the product return conditions of the relevant companies.

 

Trademarks and Intellectual Property

1. It is known that the UNVEELS website/application is merely an online intermediary between the customer and the competent company. Accordingly, UNVEELS is not responsible for any violation of the law that may be committed by the competent company. The latter is also considered responsible for all products that are displayed on the platform, and any violation of intellectual property rights or Unlawful use of trademarks, use of counterfeit products, or unlawful use of products are the responsibilities of the relevant company, and UNVEELS has no relation to that and has no responsibilities against it in this regard.

2. Any complaints regarding the trademarks displayed on the UNVEELS website/application by their owners or owners of the rights to exploit them regarding infringement or violation of their rights shall be directed in an official written letter to UNVEELS’ email info@unveels.com, and UNVEELS has the right to take action. Which it deems appropriate and in accordance with the documents submitted without any responsibility for it.

3. In the event of a violation or infringement by one of the competent companies of the intellectual property rights and trademarks of others being proven, UNVEELS has the full right to delete the infringer’s products without giving reasons, along with the right to take the necessary legal measures to protect them and their rights.

The platform may provide links to other sites on the network. Some of these websites may be affiliated with UNVEELS while others are not. UNVEELS is not responsible for the contents of any website pages created and maintained by organizations independent of UNVEELS. Visiting any third-party website pages is at the customer's own risk. UNVEELS does not have any control over the pages of these third-party websites, and cannot guarantee the accuracy, completeness, or timeliness of the information contained in the pages of such third-party websites. Your use of this information and your reliance on this information should only be made after independent review. References to commercial products or services within any third-party website pages do not constitute or imply endorsement by UNVEELS. By using the Platform, you acknowledge that UNVEELS is not responsible for the availability of other websites, or the content located on or through any other website pages.

 

Limitation of Liability

1. UNVEELS makes no representation or warranty of any kind, express or implied, regarding the availability of this platform, that it will be error-free, that defects will be corrected, or that the platform or the server that makes it available is free of viruses or other harmful components.

2. Subject to the previous paragraph, UNVEELS or its directors, officers, agents, and employees shall not have any liability for any direct or indirect losses or damages arising from the contract, any default or otherwise from the use of or inability to use this platform.

 

Platform Contact Information

1. In the event of a complaint from the customer, it will be directed by phone or by sending it to the email specified for UNVEELS. The complaint will not be accepted if it is submitted after a period estimated at (14) days starting from the date of receipt of the product.

2. To help us resolve any complaints quickly and to your satisfaction, we advise you to submit the complaint on the same day specified by you on the date of your reservation or order.

 

Clearance

While we agree to use all reasonable endeavors to ensure that the Platform is fully functional and error-free, we cannot guarantee this and, therefore, we do not accept any responsibility for any defects and/or disruption to the Platform and we are accordingly released from our obligations under these terms and conditions. In the event of any occurrence that is beyond our control, which hinders work or makes providing the platform impossible or impractical.

Termination

UNVEELS may unilaterally terminate this Agreement at any time.

 

Law and Jurisdiction

These terms are governed by and construed in accordance with the relevant laws in force within the State of Kuwait. Disputes arising and related to these terms will be subject to the jurisdiction of the Kuwaiti courts.

 

Separability

In the event that any provision of the User Agreement is determined to be invalid, void, or for any reason unenforceable, such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions of the User Agreement. In such an event, that portion shall be construed in a manner consistent with applicable laws. To reflect as closely as possible the original intentions of the parties, and the remaining parts remain in full force and effect in accordance with applicable laws. No waiver by us will be construed as a waiver of any prior or subsequent breach of any provision.

 

General Provisions

1. UNVEELS reserves the right to supplement or amend the terms and conditions that you are authorized to view on the platform from time to time without prior notice to you. We will display any changes on the platform, and it is your responsibility as a customer to review the terms and conditions every time you visit the platform. The changes will take effect immediately after any change is displayed, and all subsequent dealings between you and us will be based on the new terms and conditions.

2. In addition, we reserve the right to suspend, restrict, or terminate access to the Platform at any time.

3. UNVEELS has the right to seek compensation if your use of our platform is offensive to the platform’s functions, its operational processes, or its business reputation, or is harmful to its customers and their private personal data, whether the abuse is the result of an intentional or unintentional act.

4. The responsibility for updating/amending any customer data lies with the customer himself, and accordingly, UNVEELS disclaims and denies any responsibility for any errors or financial loss that may result to the customer because of our use of his old or incorrect data.
